An American in Austria can only work as far as their residence title allows. The rules differ sharply between a job with an Austrian employer, remote work for a US company and freelancing, and the permit you hold decides which of these is open to you. This guide sets out what the official Austrian migration portal, the business service portal and the US Social Security Administration say about each.

Start with your residence title

Austria does not have a single "work visa". Each residence title carries its own access to the labor market. The main ones Americans use:

| Title | What it allows | |---|---| | Red-White-Red Card | Fixed-term settlement and employment with the employer named in the application; generally issued for 24 months | | Red-White-Red Card plus | Fixed-term settlement and unlimited labor market access, employed or self-employed, not tied to one employer | | Red-White-Red Card for self-employed key workers | Settlement and the self-employed occupation described in the application | | Settlement permit, gainful employment excluded | As the name says, a title for people who do not work in Austria, such as retirees living on their own means |

### Working for an Austrian employer

The Red-White-Red Card for other key workers is the usual route for a job offer. According to migration.gv.at, you need at least 55 points on the criteria list, and your prospective employer must pay at least the statutory minimum, EUR 3,465 gross a month in 2026. An employer's declaration (Arbeitgebererklärung) describing the job must accompany the application. You can file at the Austrian embassy or consulate where you live, or the employer can file with the residence authority in Austria. During a legal stay, such as the visa-free period, you may also apply in person in Austria, which entitles you to stay while the application is pending.

The card ties you to that employer. You can also do subsidiary self-employed work if the other legal requirements are met. If you change employer, you can provisionally start the new job only 45 days after applying to change the purpose of your permit.

### Moving to free labor market access

After at least 21 months of qualifying employment within the previous 24 months on a Red-White-Red Card or an EU Blue Card, you can apply for the Red-White-Red Card plus. This gives unlimited labor market access, so you can change jobs or start a business without asking permission again. The Public Employment Service (AMS) assesses the employment history.

### Self-employment as your main purpose

The self-employed key worker card is demanding. Your activity must create a macroeconomic benefit beyond your own business, for example:

  • transferring at least EUR 100,000 of investment capital to Austria;
  • creating new jobs or securing existing ones;
  • transferring know-how or introducing new technologies;
  • being of considerable significance for the whole region.

You need a business plan, evidence of the capital transfer and job creation, proof of your qualifications and, where needed, trade authorizations. The residence authority forwards the file to the AMS, which issues an opinion on the macroeconomic benefit within three weeks. The card is issued for 24 months, followed by a settlement permit if you still meet the requirements.

Remote work for a US employer

Many Americans want to keep their US job and live in Vienna. Austrian law looks at two separate questions.

  1. Does your residence title let you work? Check the conditions of your permit with your residence authority before you start. A settlement permit with gainful employment excluded is, by its name and design, meant for people who do not work.
  2. Where are you taxed and insured? This depends on residence and on the US-Austria agreements, not on where your employer is based.

### Austrian tax residence

The Austrian business service portal states that everyone with a domicile in Austria, or whose usual place of residence is Austria, has unrestricted tax liability. In principle, all of their Austrian and foreign income is subject to Austrian income tax. Double taxation agreements exist so that nobody is taxed twice on the same income. Nationality rarely matters.

In practice, if you live in Austria, your US salary is within the reach of Austrian income tax, and the US-Austria treaty decides how the two countries share it.

### Social Security

The United States and Austria have a Social Security agreement. The SSA explains the basic employee rule: if your employer sends you from one agreement country to another for five years or fewer, you stay covered by your home country and are exempt in the other. A remote worker who simply moves on their own is a different case. Get the coverage question answered before you start, because both countries' systems could otherwise claim contributions.

Freelancing

Austria distinguishes several forms of independent work, and migration.gv.at explains them.

  • New self-employed workers (Neue Selbständige) carry out activities that need no trade license, such as writers, consultants, translators, lecturers and psychotherapists. They must report their activity to the Social Insurance Institution for the self-employed (SVS) and are covered by sickness, pension and accident insurance. Since 2009 they can opt in to unemployment insurance.
  • Activities that require a trade license (Gewerbeschein) need that license before you start.
  • Freelance service contractors (freie Dienstnehmer), such as language instructors, have limited labor law protection but almost full social insurance, including unemployment insurance since 2008.

Watch the label on your contract. The migration portal warns that a contract may say "freelance" while the reality is personal dependence, with instructions, working hours and place set by the client. What counts is the actual situation.

### US self-employment tax

For self-employed Americans resident in Austria, the agreement has a specific rule, set out in the SSA's operations manual: if your self-employment income would be covered by both countries, you are covered only by the country where you reside. If that is Austria and you are exempt from US self-employment tax, you still file a US return every year, and you must:

  • mark the earnings as exempt under the agreement on Schedule SE;
  • request a certificate of coverage from the Austrian authorities;
  • attach a copy of the Austrian certificate to your US return every year.

Part-time and marginal jobs

Austrian part-time employees have the same labor rights and insurance protection as full-time staff, except for marginal employment. Marginal employment (geringfügige Beschäftigung) is a job paying no more than EUR 551.10 a month in 2026. It carries accident insurance only, though voluntary health and pension insurance is available. Even a small job needs a permit that allows it.

US tax filing

The IRS taxes US citizens on worldwide income wherever they live. You may be able to exclude foreign earned income up to an annually adjusted limit if you pass the bona fide residence test, an uninterrupted period that includes a full tax year, or the physical presence test of at least 330 full days abroad in any 12 consecutive months.

A checklist

  1. Confirm what your residence title allows before taking any work.
  2. If employed, keep track of the 21 months toward the Red-White-Red Card plus.
  3. Check your contract type against the reality of the work.
  4. As a freelancer, register with the SVS or get the trade license first.
  5. Settle Social Security coverage and get the Austrian certificate if you are self-employed.
  6. File in both countries, using the treaty and the IRS rules to avoid double tax.

Common questions

Can I work remotely for a US company while living in Austria? Only if your residence title permits it. If you live in Austria, you are generally subject to unrestricted Austrian income tax on your worldwide income, with the treaty preventing double tax.

What salary does the Red-White-Red Card require? For other key workers, the employer must pay at least EUR 3,465 gross a month in 2026, and you need at least 55 points.

Can I change employer on a Red-White-Red Card? Yes, but you may provisionally start the new job only 45 days after applying to change the permit's purpose.

Do self-employed Americans in Austria pay US self-employment tax? Under the US-Austria agreement, self-employed people are covered by their country of residence. To prove the exemption, attach the Austrian certificate of coverage to each US return.
